2. Scope of This Policy

This SMS & Call Policy applies to SMS, MMS, and telephone-call features made available through Orvion and to businesses that use those features to communicate with their customers, prospects, and other contacts.

Orvion provides communications software and related automation. A business using Orvion is responsible for determining whether it has the legal right and any required consent to contact a particular person.

This Policy supplements the Orvion Terms of Service and Privacy Policy.

3. Types of Communications

Depending on how a business configures and uses Orvion, communications may include:

  • responses to customer inquiries;
  • service-request follow-up;
  • appointment and booking confirmations;
  • scheduling and rescheduling messages;
  • appointment reminders;
  • status updates;
  • requests for additional information;
  • customer-service communications;
  • missed-call or callback follow-up;
  • transactional notices;
  • other messages or calls that a customer has requested or consented to receive; and
  • marketing or promotional communications only where the business has obtained any consent required by applicable law and telecommunications rules.

Message frequency varies depending on the customer's interactions with the business, the nature of the service request, and the communications the customer has requested or consented to receive.

4. Consent and Permission

Businesses using Orvion must obtain and maintain all permissions, notices, and consents required by applicable law, carrier requirements, and messaging-industry rules before sending communications.

Consent must be appropriate for the type of communication being sent.

Where express consent is required, the recipient must be informed of:

  • the identity of the business sending the communication;
  • the general nature of the communications;
  • how the recipient's phone number will be used;
  • how to obtain help; and
  • how to withdraw consent or opt out.

Where applicable, consent to receive marketing SMS messages or automated marketing calls must be obtained separately from consent for other communication channels and separately from acceptance of general terms.

Consent to receive marketing text messages or calls is not a condition of purchasing goods or services where applicable law requires that disclosure.

Businesses must retain appropriate records of consent where required and must be able to demonstrate how and when consent was obtained.

5. SMS Opt-In

A recipient may opt in to receive SMS messages through methods permitted by the relevant business and applicable law, which may include:

  • submitting a web form with an SMS consent selection;
  • initiating an SMS conversation;
  • texting an opt-in keyword;
  • requesting text communication during another customer interaction; or
  • another clear and documented opt-in method.

Where a web form is used for SMS consent, businesses should present SMS consent clearly and separately from unrelated consents. Optional consent checkboxes should not be pre-checked.

The business is responsible for ensuring that its opt-in language accurately describes the messages the recipient will receive.

6. SMS Program Disclosures

For recurring SMS communications sent through Orvion:

  • Message frequency may vary.
  • Message and data rates may apply.
  • Recipients may reply STOP to opt out.
  • Recipients may reply HELP for help where supported.
  • Carriers are not liable for delayed or undelivered messages.

Businesses using Orvion must include additional disclosures where required by applicable law, carrier requirements, or the relevant messaging program.

7. Opt-Out and Revocation of Consent

Recipients may withdraw consent to SMS communications at any time.

For supported SMS programs, replying STOP will opt the recipient out of further messages from the applicable messaging program or sender, subject to any legally permitted confirmation message.

Other commonly recognized opt-out requests, such as UNSUBSCRIBE, CANCEL, END, QUIT, or equivalent plain-language requests, should also be honored where required by applicable law or carrier rules.

After an opt-out request is received:

  • the sender must stop sending messages covered by the opt-out;
  • the sender may send a single confirmation of the opt-out where permitted; and
  • no further messages covered by that opt-out should be sent unless the recipient later provides valid new consent.

Businesses using Orvion are responsible for honoring opt-out requests across their applicable communication systems.

8. HELP and Customer Support

Where supported, recipients may reply HELP for assistance.

Customers may also contact the relevant business directly using the contact details provided by that business.

9. Telephone Calls

Businesses may use Orvion to assist with inbound and outbound telephone communications.

Businesses are responsible for complying with all laws and rules applicable to calls they make or initiate, including requirements concerning:

  • consent to automated, artificial-voice, prerecorded, or marketing calls;
  • do-not-call registries and internal do-not-call requests;
  • caller identification;
  • calling hours;
  • abandoned calls;
  • call frequency;
  • recordkeeping; and
  • any additional rules applicable to the business, jurisdiction, or use case.

A business must not use Orvion to place calls to a person when the business does not have the legal authority to make that call.

10. Call Recording and Transcription

Orvion may support call recording, transcription, or automated analysis where those features are enabled.

Laws governing call recording and transcription vary by jurisdiction.

Businesses using these features are solely responsible for:

  • determining whether recording or transcription is lawful;
  • providing any legally required notice;
  • obtaining any legally required consent;
  • configuring the feature appropriately; and
  • retaining or deleting recordings and transcripts in accordance with applicable law.

Orvion does not authorize a business to record or transcribe a communication where doing so would be unlawful.

11. Sender Identification

Businesses using Orvion must accurately identify themselves in communications where required.

They may not:

  • impersonate another person or business;
  • use misleading sender information;
  • disguise the origin or purpose of a communication; or
  • use Orvion for phishing, fraud, or deceptive communications.

12. Prohibited Messaging and Calling Practices

Orvion may not be used to:

  • send unlawful spam;
  • send messages or place calls without required consent or authority;
  • ignore valid opt-out or do-not-call requests;
  • harass or threaten recipients;
  • send fraudulent, misleading, or deceptive content;
  • impersonate another person or organization;
  • facilitate phishing or credential theft;
  • transmit unlawful content;
  • evade carrier filtering, registration, or compliance requirements;
  • artificially inflate traffic or engagement; or
  • violate applicable telecommunications laws, carrier policies, or industry standards.

Orvion may restrict or suspend communications functionality where reasonably necessary to address abuse, fraud, security risks, carrier requirements, or legal obligations.

13. Mobile Information and SMS Consent Data

Orvion does not sell mobile phone numbers or SMS opt-in data.

We do not sell or share SMS opt-in data, mobile information, or consent records with third parties for their own marketing or promotional purposes.

Information may be shared with telecommunications providers, messaging vendors, infrastructure providers, and other service providers only as reasonably necessary to deliver communications, operate the Service, maintain security, prevent fraud, provide support, or comply with law.

All categories of data sharing described in the Orvion Privacy Policy exclude text-messaging originator opt-in data and consent where disclosure would be for a third party's own marketing or promotional purposes.

14. Delivery and Carrier Limitations

SMS and telephone communications depend on telecommunications carriers, networks, devices, third-party providers, and recipient availability.

Delivery is not guaranteed.

Messages or calls may be delayed, filtered, blocked, rejected, or undelivered because of factors outside Orvion's reasonable control.

Wireless carriers are not liable for delayed or undelivered messages.

15. Charges

Orvion does not charge an end recipient a separate fee merely for receiving an SMS through the Service.

However, message and data rates may apply under the recipient's mobile plan.

Telephone, roaming, data, or other carrier charges may also apply according to the recipient's agreement with their telecommunications provider.

16. Emergency Use

Orvion is not an emergency communications service.

Businesses and end users must not rely on Orvion to contact police, fire, ambulance, emergency dispatch, or other emergency services, or for communications where delay or failure could create an immediate risk of injury, death, or serious property damage.

17. Business Customer Responsibilities

A business using Orvion's SMS or call functionality is responsible for:

  • the recipients it contacts;
  • the legal basis and consent for those contacts;
  • the accuracy of its sender identity;
  • the content and purpose of its communications;
  • honoring opt-outs and do-not-call requests;
  • maintaining consent and compliance records where required;
  • complying with applicable laws and industry rules; and
  • ensuring that its own website, forms, advertisements, and other opt-in mechanisms contain required disclosures.

Orvion may provide tools that assist with compliance, but those tools do not transfer the business customer's legal responsibilities to Orvion.

18. Privacy

Personal information processed through SMS and call functionality is handled as described in the Orvion Privacy Policy:

https://getorvion.com/privacy

Businesses using Orvion must also maintain any privacy notices required for their own customers and communications.

19. Changes to This Policy

We may update this SMS & Call Policy from time to time.

When we make changes, we will update the Effective Date shown at the top of this page. If applicable law requires additional notice, we will provide such notice.
